1. Agreement
By accessing mathewmoira.com or engaging our web design services, you agree to these Terms and Conditions. If you do not agree, do not use this website or our services.
2. Services
Mathew Moira provides custom WordPress website design, hosting, maintenance, and CRM integration services. The scope, deliverables, timeline, and pricing for each project are defined in a written proposal agreed upon before work begins.
3. Payment Terms
A non-refundable deposit of 50% is required before work begins on any project. The remaining balance is due upon project completion before the website is transferred to your hosting or made live. Hosting and maintenance fees are billed monthly in advance.
4. Client Responsibilities
You agree to:
- Provide accurate business information, content, and materials required for the project in a timely manner
- Review and provide feedback within agreed timeframes
- Communicate clearly and promptly throughout the project
Delays caused by late content delivery or feedback may extend the project timeline at no fault of ours.
5. Revisions
Each project includes a defined number of revision rounds as specified in your proposal. Additional revisions beyond the agreed scope will be billed at an hourly rate.
6. Intellectual Property
Upon receipt of full payment, you own 100% of your completed website, including all design files, content, and code. We retain the right to display your completed website in our portfolio unless you request otherwise in writing.
7. Hosting and Maintenance
Monthly hosting and maintenance services continue until cancelled. You may cancel at any time with 30 days written notice. No refunds are issued for the current billing month upon cancellation.
8. Confidentiality
Both parties agree to keep confidential any sensitive business information shared during the project engagement.
9. Limitation of Liability
Our total liability to you for any claim arising from our services is limited to the amount you paid us for the specific service in question. We are not liable for indirect, incidental, or consequential damages.
10. Termination
Either party may terminate a project engagement with written notice. If you terminate after work has begun, you forfeit the deposit. If we terminate, we will refund any payment made beyond work completed to date.
11. Governing Law
These terms are governed by the laws of Kenya. Any disputes will be resolved through good faith negotiation before any legal proceedings.
12. Changes
We may update these Terms and Conditions at any time. Continued use of our services constitutes acceptance of the updated terms.
